Terms and conditions
1. General
These terms of purchase apply to the sale of products to consumers in the Ski-WSC online store.
Together with your order and our order confirmation, the terms of purchase constitute the agreement for the purchase. Consumer purchases are also regulated by mandatory rules in the Consumer Purchase Act, the Cancellation Act, the Marketing Control Act, the Personal Data Act, the E-Commerce Act and the Credit Purchase Act. For complete legal texts, see https://lovdata.no/. The terms of this agreement shall not be construed as a limitation of these statutory rights, but set out the parties' most important rights and obligations for the transaction.
2. Definition of the parties
Seller is: IDÉ House of Brands AS, Stortorvet 10, 0155 OSLO, org.nr. NO 942 425 945 MVA, Phone: 23 31 01 80 and e-mail skivm25@idegroup.no (here in after referred to as "IDÉ", "we" or "us").
Buyer is: the person stated as the buyer in the order (hereinafter referred to as "you", "you" and "your").
3. Ordering and contracting process
Your order is binding when the order is registered with us. We are also bound by your order if it does not deviate from what is offered by us in our online store or our marketing. However, you have the right to withdraw from the purchase in accordance with the law on the right of withdrawal, see section 7 of the agreement. 7.
When we receive your order, you will receive an electronic order confirmation by email. Please read the order confirmation carefully and check whether the content is in accordance with the desired order.
4. Prices & Taxes
- All prices listed on our webshop are exclusive of MVA (Value Added Tax).
- Customers are responsible for paying any applicable customs duties and taxes upon receiving their goods.
When purchasing goods, the prices stated for the products on Ski-WSC on the day of the order apply. Any price changes that occur after the time of order will not have retroactive effect.
If there have been typing or printing errors in the offer of product prices in advertisements etc. or in the online store that deviate more than 15 percent of the normal retail price, IDÉ may unilaterally change, delete or reject the order. This applies even if the buyer has received an order confirmation. However, such errors must be corrected by IDÉ within a reasonable time after the error is discovered or reported to us.
5. Payment
The purchase price can be settled using the online payment options available for the online store. In the case of online payment, an amount corresponding to the sum on the order confirmation will be reserved. When all the goods have been collected, picked and the shipment leaves our warehouse, you will be charged according to the final total on the order confirmation.
6. Delivery
Some items may be made to order. This means that we have to order the item from the manufacturer or factory, where it then goes to a printer for printing of the profile and labels. Deliveries of made-to-order goods will therefore have a longer delivery time than goods that are in stock. Items that are made to order must be clearly marked on each product. We collect all items before they are sent to the specified delivery address. As the reservation of the order has an expiration date, we can debit the reservation when the goods are confirmed shipped from the manufacturer or third party. For fast delivery, the purchase of stock items is recommended.
Stock items are delivered by PostNord from our warehouse DSV. Normal delivery time is 3-5 business days depending on the delivery destination of the goods.
7. Right of withdrawal
The Cancellation Act gives you the right to cancel your purchase. The right of withdrawal requires that you notify us within 14 days of receiving the delivery (withdrawal period).
If you have not received a withdrawal form either in the order confirmation or upon delivery of the products, the withdrawal period expires 12 months after the expiry of the original withdrawal period. If you receive a withdrawal form within these 12 months, the withdrawal period expires 14 days after the day you received the withdrawal form.
In order for the right of withdrawal to be exercised, the product must have been delivered to us in approximately the same quantity and condition as you received it. If you use or examine the product(s) in a way that goes beyond what is necessary to determine the nature, characteristics and function of the product and this results in a reduction in value, we may deduct an amount corresponding to the reduction in value from the purchase price to be refunded.
All products must be returned to us within a reasonable time. Any return shipment must be paid by the buyer. The buyer bears the risk of transporting the goods back to us.
You will receive a withdrawal form with the goods. You can also find the withdrawal form here in the online store.
8. Examination of the products
After you have received the products, you should - as soon as you have the opportunity to do so - check whether the delivery is in accordance with the order confirmation. Check whether the products have been damaged during transportation, or whether the products are otherwise defective. If a fault or defect is discovered, you must inform us at skivm25@idegroup.no within a reasonable time after you have discovered, or should have discovered, that you wish to make a complaint about the goods. However, the deadline for making a complaint is no longer than two months from the time you discovered the defect.
9. Change in the terms of purchase
We reserve the right to change the terms of this agreement with effect for future purchases.
10. Force majeure
Neither party is obliged to fulfill the agreement or obligations incurred hereunder when the fulfillment is prevented by force majeure.
